Customer App Terms of Service

1. About these terms

These Terms of Service ("Terms") are the agreement between you and Qtap covering your use of the Qtap mobile app and everything you do inside it. By creating a Qtap account and using the app, you agree to these Terms. If you do not agree, please do not use Qtap.

We also have a Privacy Policy that explains what we do with your data. It is separate from these Terms but just as important. You should read it.

These Terms are written in plain English. Where we use a legal term, we try to explain what it means. If you ever want clarification, email support@qtap.qa and we will explain.

2. Who Qtap is

Qtap operates as two entities: Qtap Inc., a limited liability company registered in Doha, Qatar (the entity that contracts with you under these Terms), and Qtap Loyalty LLC, a limited liability company registered in Delaware, USA (our parent company; does not contract directly with you but may share responsibilities for running the service). When these Terms say "Qtap," "we," "us," or "our," we mean Qtap Inc., unless context says otherwise.

3. Who can use Qtap

You can use Qtap if you are at least 16 years old, can legally enter into a binding contract in your country, and are not barred from using the app under applicable law or any prior suspension by Qtap. If you are under 16, you cannot have a Qtap account; if we find out you are under 16, we will delete your account.

If you are creating an account on behalf of someone else (for example, a family member), you need their permission and you are responsible for their use of the account. We strongly prefer each person to have their own account.

4. Your Qtap account

Creating an account

When you sign up, you give us your name, email, phone number, and a password. You confirm that this information is accurate and that the phone number and email belong to you. We generate a permanent Qtap ID for you (the letter Q followed by seven characters); this ID does not change for the life of your account. Merchants use it to recognize you without needing your phone number.

Keeping your account secure

You are responsible for everything that happens under your account. Keep your password private; do not share your login with anyone; do not share your device while logged in; tell us immediately if you think someone else has accessed your account. If someone uses your account without your permission because you shared your credentials, we are not responsible for what they do.

One account per person

You can only have one Qtap account. Creating multiple accounts to earn extra rewards, exploit sign-up bonuses, or game campaigns is a violation and will get all your accounts suspended.

5. How Qtap actually works

Qtap is a loyalty platform. Businesses set up loyalty programs in Qtap. You join those programs and earn stamps, points, or rewards when you visit and tap your phone on their Qtap device or scan their QR code.

When you tap or scan: Qtap confirms the business, location, and time; Qtap adds stamps or points to your card with that specific business; the business sees your activity in their dashboard; you get an in-app notification, and sometimes a push or SMS.

Qtap connects you and the business. We do not sell you anything. We do not set the prices, the menu, or the rewards. Each business decides those things.

What we provide

The Qtap app and its features; the secure account system; the stamp and point tracking; the connection to each business's loyalty program; customer support for app-related issues.

What each business provides

Their own products and services; the specific rewards they offer; the fulfillment of those rewards in person; customer service for their store and their products.

If you have a problem with a product, a staff member, or a reward not delivered, that is a dispute between you and the business. We can sometimes help mediate, but the business is the party you need to resolve it with.

6. Stamps, points, and rewards

Stamps and points feel like money, and we need to be clear that they are not.

  • No cash value. Stamps and points have no cash value. You cannot sell them, trade them, or exchange them for money.
  • Not transferable. Stamps and points belong only to your account. You cannot move them to another person or another account.
  • Program-specific. Stamps you earn at one business only work at that business.
  • Expiration. Each business sets its own expiration rules; the expiration (if any) is shown in the app when you join their program.
  • Redemption. Rewards are redeemed in person at the business. Qtap does not deliver rewards and does not guarantee a specific item will be in stock.
  • Cancellation by the business. A business can end its loyalty program, change rules, or leave Qtap at any time. If a business leaves Qtap, their unredeemed stamps and points disappear; we will give reasonable notice when we know in advance.
  • Fraud. If we believe stamps or points were earned through fraud, tap manipulation, or campaign abuse, we will reverse them.

7. Merchant campaigns and communications

Businesses you join can send you reminders about your stamps, new rewards or offers, event invitations, and seasonal promotions. You control whether these come as push notifications, email, or SMS, set once per business in the app.

You can opt out of any business's messages at any time by going to their loyalty card in the app and changing your notification settings. You can also leave any loyalty program at any time. Leaving a program stops all communication from that business and hides your card; transaction history is retained anonymized (Privacy Policy Section 9).

You cannot opt out of transactional messages essential to the service (stamp confirmations, security alerts). If you do not want these, you need to delete your Qtap account.

8. Things you cannot do

Do not use Qtap to:

  • Tap fraudulently. Do not record taps when you are not physically present, use another person's phone to earn stamps on your account, or coordinate with staff or other customers to fake transactions.
  • Create multiple accounts. See Section 4.
  • Use bots or scripts or automated tools to interact with Qtap.
  • Resell or sublicense your account or your rewards.
  • Reverse-engineer the app.
  • Interfere with the service by probing for vulnerabilities, overwhelming servers, or attacking the system. Report security issues to security@qtap.qa.
  • Abuse other users or merchants. Do not harass, threaten, or impersonate anyone.
  • Use Qtap for anything illegal, including money laundering, tax evasion, or buying goods that are illegal in Qatar.
  • Violate a business's rules. If you violate house rules, the business can remove you from their program.

If you violate any of these, we may suspend your account, reverse stamps or points earned through the violation, report you to authorities, or terminate permanently. We choose the response based on what happened.

9. Suspension and termination

When you can end your account

You can close your Qtap account at any time from Settings, Account, Delete Account. See Privacy Policy Section 9 for what happens to your data.

When we can suspend or end your account

We can suspend or close your account if you violate these Terms; use the service in a way that puts other users, merchants, or our systems at risk; we are required to do so by law; or you are inactive for a very long time and we have warned you first. When we suspend, we will usually tell you what you did and give you a chance to fix it. For serious or repeated violations we may not.

What happens to your stamps and rewards when your account ends

If you close your account yourself, you lose all unredeemed stamps, points, and rewards. If we close your account because of your violation, you also lose all unredeemed stamps, points, and rewards; we do not owe compensation because they had no cash value. If we close your account for reasons not your fault (we shut down the service), we will give reasonable notice and work with participating businesses to help you redeem what you have.

10. Intellectual property

What Qtap owns

The Qtap app, name, logo, website, and everything in them (code, design, graphics, text, data models, the concept of how Qtap works) belong to Qtap or our licensors and are protected by copyright, trademark, and other intellectual property laws in Qatar and internationally.

What we allow you to do

We give you a personal, non-exclusive, non-transferable, revocable license to use the Qtap app on your device for your own personal, non-commercial use. You cannot copy, modify or create a derivative version, distribute, resell, or publicly display the app; remove or alter copyright/trademark/proprietary notices; or use the Qtap name or logo in your own marketing without written permission.

What you own

Anything you create and upload (like a profile photo) stays yours. By uploading, you give us permission to display it back to you and to the businesses you have joined, only for running your account. We will never use your uploads for advertising, public display, or training AI models without asking you first.

11. Our disclaimers

The Qtap app is provided on an "as is" and "as available" basis. We do not promise the app will always be available, uninterrupted, or error-free; we do not promise specific businesses will always be on Qtap; we do not promise any specific reward, offer, or campaign will be available when you expect it; we do not guarantee push, SMS, or emails will arrive on time; we do not control your mobile network, Wi-Fi, or device; we do not verify the accuracy of business campaigns. To the maximum extent allowed by law, we disclaim all implied warranties, including merchantability, fitness for a particular purpose, and non-infringement.

12. Limitation of liability

Because Qtap is free for you to use, our liability to you is limited. To the maximum extent allowed by law, Qtap's total aggregate liability to you for anything in connection with the app is limited to QAR 500 (five hundred Qatari Riyals).

We are not liable for indirect, incidental, special, consequential, or punitive damages, including loss of rewards, loss of data, loss of profits, or loss of opportunity. This applies whether the claim is based on contract, tort, negligence, statute, or any other theory, even if we knew the damages were possible.

Some legal systems do not allow certain exclusions; in those places the limitations apply only to the extent the law allows.

13. Indemnification

If your use of Qtap causes a claim against us from someone else (you harass a merchant who sues Qtap, or you use the app for something illegal and a government investigates Qtap), you agree to defend us, pay the costs of defending, and pay any damages we are ordered to pay. This does not apply if the claim is caused by our own actions or by something we did wrong.

14. Apple App Store terms

If you downloaded Qtap from the Apple App Store: these Terms are between you and Qtap, not Apple. Apple is not responsible for the app or its contents. Your iOS license is limited to devices you own or control under Apple's usage rules. Qtap (not Apple) provides any maintenance or support. If the app fails to conform to a warranty, you can notify Apple and Apple will refund any purchase price; Apple has no other warranty obligation. Qtap addresses any product, legal compliance, or consumer protection claims. Qtap handles third-party intellectual property infringement claims. You confirm you are not in a US-embargoed country or on a US prohibited parties list. Apple and Apple's subsidiaries are third-party beneficiaries and can enforce these Terms against you.

15. Google Play Store terms

If you downloaded Qtap from the Google Play Store, your use is also subject to Google's Terms of Service and Google Play Developer Distribution Agreement. Nothing in these Terms overrides those.

16. Changes to these terms

We can change these Terms. When we do, we will post the updated version in the app at least 14 days before it takes effect, notify you in the app, and for material changes ask you to re-accept before continuing. If you do not agree to a change, you can close your account before the new version takes effect; continued use means acceptance.

17. Governing law and dispute resolution

These Terms are governed by the laws of the State of Qatar, without regard to conflict-of-laws rules.

Disputes are resolved as follows: (1) Talk to us first by emailing support@qtap.qa with a clear description; we commit to a written response within 14 days. (2) If we cannot resolve, the dispute is submitted to the Qatar Financial Centre Civil and Commercial Court (QFC Court), which has exclusive jurisdiction. If the QFC Court declines, the courts of the State of Qatar in Doha have exclusive jurisdiction.

Nothing in this section prevents either party from seeking urgent injunctive relief in any court with jurisdiction.

18. Miscellaneous

Entire agreement. These Terms and the Privacy Policy are the entire agreement between you and Qtap about the app. Severability. If any part is unenforceable, the rest stays in force. Waiver. If we do not enforce a right, we have not given it up. Assignment. You cannot transfer your rights; we can assign to a successor or affiliate. No agency. No partnership, joint venture, agency, or employment relationship is created. Notices. We send formal notices to your account email; send formal notices to legal@qtap.qa. Force majeure. Neither side is liable for failures from events outside reasonable control. Language. English governs in case of conflict, unless required otherwise by applicable law.
